iKredo Membership Agreement (template)

concluded pursuant to Section 1746(2) of Act No. 89/2012 Coll., the Civil Code

Provider: KREDO Digital Finance a.s., Company ID No. 09062530, registered office [to be completed], represented by [to be completed] (hereinafter "KREDO") Member: name and surname / business name, date of birth / Company ID No., address, e-mail (hereinafter the "member")

I. Subject matter of the agreement

  1. KREDO undertakes to make the iKredo members' area and the tools accessible to the member to the extent set out in the General Terms and Conditions of Membership (GTC) and the Terms of Use of the iKredo Website and Tools, which form an integral part of this agreement.
  2. The member undertakes to use the members' area in accordance with this agreement, the GTC, the Terms of Use and the Community Rules.

II. Declarations of the member

The member declares that:

a) they are at least 18 years of age or, as the case may be, are authorised to act on behalf of a legal entity;

b) they acknowledge that iKredo, its indicators, analyses, indices, virtual portfolios and Analyst outputs are not an investment recommendation, investment research or an investment service, and that KREDO does not trade on their behalf or manage their assets;

c) they make every investment decision themselves, at their own responsibility and risk, and have familiarised themselves with the risks of CFD trading and with leverage;

d) they acknowledge that Analyst outputs are produced by a language model and may contain errors; they undertake to verify them before use;

e) they acknowledge that the Czech versions of documents in the data warehouse are machine translations and that the original prevails;

f) they expressly request that the members' area be made accessible immediately after the conclusion of the agreement and acknowledge the consequences for the right of withdrawal under Section 1837(l) of the Civil Code (Article 4.3 of the GTC);

g) they agree to the Community Rules and to the processing of personal data to the extent set out in the Privacy Policy (processing on the basis of contract and legitimate interest; consent is required only for commercial communications, if given).

III. Price

Membership during beta operation is free of charge. The introduction of a price is governed by Article 3 of the GTC.

IV. Duration and termination

The agreement is concluded for an indefinite period; termination and withdrawal are governed by Article 4 of the GTC.

V. Confidentiality and intellectual property

  1. The content of the members' area is confidential; the member shall not use it other than for their own needs and shall not make it accessible to third parties.
  2. All rights in the designations iKredo, Heat, Swan, SEXY, BOLD, in the indices, the methodology, the database and the software belong to KREDO.

VI. Final provisions

  1. The law of the Czech Republic; disputes shall be decided by the courts of the Czech Republic; a consumer may use the Czech Trade Inspection Authority (ČOI) (www.coi.cz) and the ODR platform.
  2. The agreement is concluded electronically: by acceptance of the offer by ticking the consent during registration; KREDO retains a record of the acceptance (date, time, e-mail, IP address) and sends the member a confirmation with the text of the agreement, the GTC and the Terms of Use in durable (text) form.
  3. The Czech version prevails.
